Terms and Conditions for The Propertic

Welcome to The Propertic. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and content (collectively, "Services"). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Introduction to Our Services

The Propertic offers a comprehensive suite of services designed to empower you with informed decisions regarding both property investment and home enhancement in Dubai and the wider UAE. Our Services include:

  • Home Renovation Service: We facilitate connections with licensed contractors to provide professional home renovation services for pre-owned or after-market homes. This includes everything from design consultation and project management to the execution of luxurious renovation works.
  • Bespoke Furniture (Carpentry) Service: We facilitate connections with skilled carpenters and licensed contractors to design, craft, and install bespoke custom-made furniture and carpentry solutions, perfectly tailored to your specific design preferences and spatial requirements.
  • Off-Plan Property Consultation Service: We connect you with independent, licensed real estate brokers in the UAE. These brokers provide free, personalized guidance and expert consultations on off-plan property investments, aligning with your stated goals and requirements. We do not display properties directly, ensuring you receive focused, tailored advice rather than being overwhelmed by listings.
  • And more to come! We are continuously exploring and will be adding new services designed to elevate and add luxury to your life.

2. Our Role and Disclaimer

The Propertic operates as a facilitating platform only. We connect you with independent, licensed third-party professionals for each service.

  • For Home Renovation, Smart Home System Installation, and Bespoke Furniture Services: We connect you with independent, licensed contractors and skilled professionals. The Propertic does not directly provide construction, renovation, installation, or carpentry services. Any contracts, agreements, or arrangements for services, payments, warranties, or disputes are exclusively between you and the respective licensed contractor. We are not a party to such agreements and bear no responsibility or liability for the quality of workmanship, materials, project timelines, or any disputes arising from the services rendered by these third-party contractors.
  • For Off-Plan Property Consultations: We introduce you to licensed real estate brokers. Please understand that The Propertic does not offer direct real estate brokerage services, investment advice, or legal advice. All agreements, contracts, or transactions you enter with these brokers, developers, or any other third parties are solely between you and those third parties. We are not a party to such agreements and hold no responsibility or liability for their terms, execution, or any outcomes.

It is your sole responsibility to conduct your own comprehensive due diligence, verify the credentials, licenses, insurance, and reputation of any real estate broker or contractor introduced by The Propertic before engaging in any services or transactions with them.

3. Your Responsibilities as a User (Client)

By using our Services, you ("the Client") acknowledge and agree to:

  • Accuracy of Information: Provide accurate, current, and complete information when requested for any of our services.
  • Lawful Use: Use the Services for lawful purposes only and in full compliance with all applicable laws and regulations of the UAE.
  • Independent Judgment: Exercise your own independent judgment and discretion when interacting with and making decisions based on advice or services from any third-party brokers or contractors introduced through our platform.
  • Due Diligence: Conduct your own thorough research and due diligence on any property, developer, investment opportunity, or service provider. This includes, but is not limited to, reviewing all terms and conditions of sales and purchase agreements, service contracts, and verifying all details.
  • Verification of Details: Independently verify all details provided by any consultant, developer, contractor, or other sources before making a purchase decision or committing to a service. This includes, for properties: features, pricing, payment terms, and developer reputation; and for home services: project scope, materials, pricing, timelines, and contractor credentials.
  • Financial Planning: Ensure you can afford any investment or service, including all associated costs, fees, and payment schedules. Understand that failure to make timely payments to a developer or contractor may result in consequences, including penalties, fines, or termination of agreements.
  • Non-Reliance: Acknowledge that you are not relying solely on The Propertic for your investment or home service decisions. You understand our role is limited to providing connections, information, consultation facilitation, and that we do not guarantee the performance, profitability of any investment, or the outcome of any home service project.
  • Prohibited Activities: Agree not to:
    • Use the Service for any unlawful or unauthorized purpose.
    • Interfere with or disrupt the Service or servers.
    • Attempt to hack, crack, or otherwise compromise the security of the Service.
    • Use any robot, spider, or other automated device to access or use the Service.

4. Limitation of Liability

To the maximum extent permitted by law, The Propertic, its affiliates, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the Services.
  • The conduct or content of any third party (including licensed real estate brokers or contractors) encountered through the Services.
  • Any unauthorized access, use, or alteration of your transmissions or content.
  • Any errors, omissions, or inaccuracies in information provided by developers, consultants, contractors, or other sources.
  • Any delays or issues with payment schedules, including penalties or fines imposed by developers or contractors.
  • Any losses, damages, or consequences arising from your failure to conduct adequate due diligence or verify details.
  • Your investment decisions, including any financial losses or difficulties resulting from those decisions.
  • Any disputes or issues arising directly between you and any third-party real estate broker, developer, contractor, or other service provider introduced through our platform.

5. Intellectual Property

All intellectual property rights in the Service, including but not limited to trademarks, copyrights, trade secrets, designs, and content, are owned by The Propertic or its licensors. You agree not to reproduce, distribute, modify, display, or create derivative works from any content or aspect of the Service without our prior written consent.

6. Privacy Policy

Your use of our Services is also governed by our Privacy Policy, which details how we collect, use, process, and protect your personal information. By using our Services, you consent to the data practices described in our Privacy Policy. You confirm that you have reviewed and agreed to The Propertic Data Privacy Policy.

7. Termination

The Propertic reserves the right to terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if we believe you have breached these Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the Federal laws of the United Arab Emirates, as applicable. Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or invalidity thereof, shall be referred to the courts of the Emirate of Dubai for final resolution.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is deemed material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
