Question 1

Can overseas investors buy Dubai property without a UAE residency visa?

Accepted Answer

Yes. Non-resident foreigners can buy property in Dubai without holding a UAE residency visa, subject to the property's ownership rules and location. Foreign nationals can own freehold property in areas designated for foreign ownership. A valid passport is accepted for non-resident buyers, and a legal power of attorney can be used where someone is acting on the buyer's behalf. Ownership of a completed property is registered with the Dubai Land Department (DLD).

Question 2

What are freehold zones and how many exist in Dubai?

Accepted Answer

Freehold zones are areas designated under Dubai's real-estate ownership regulations where foreign nationals may hold freehold ownership of property and land. Regulation No. 3 of 2006 established designated areas for non-UAE nationals, with additional areas designated under subsequent decisions and regulations. Major freehold areas include Downtown Dubai, Dubai Marina, Palm Jumeirah, Business Bay, Jumeirah Village Circle, Dubai Hills Estate, Emaar Beachfront, MBR City, Dubai Creek Harbour and Arjan. Outside designated freehold areas, other property rights may apply, including usufruct and long-term lease rights, depending on the property and applicable regulations.

Question 3

Off-plan vs. ready, what is the real difference?

Accepted Answer

Off-plan means buying a property from a developer before construction is complete. The sale is registered with DLD in the provisional/interim register, rather than receiving the final title deed at the time of purchase. DLD's initial-sale registration service issues a provisional registration e-certificate, and the registration is subsequently transferred to the final real-estate register and title deed upon completion and handover, subject to the applicable procedures. Ready property means a completed property, typically purchased from an existing owner on the secondary market. Once the sale is completed and registered with DLD, the title deed is transferred to the buyer. Off-plan purchases commonly involve developer payment plans, while ready properties can provide the possibility of rental income once acquired and handed over. Which option is more suitable depends on the buyer's investment objectives, financing, timeline and risk tolerance.

Question 4

How does DLD registration and escrow protect off-plan buyers?

Accepted Answer

Dubai's off-plan framework requires developers to register eligible projects and establish a project-specific escrow account before selling off-plan units. Buyer payments for off-plan units are deposited into the project's escrow account and are subject to the controls and monitoring established under Dubai's escrow-account framework. Off-plan sales are registered in DLD's provisional/interim register, which protects the buyer's registered interest before completion. The final title registration follows completion and the applicable handover procedures. If a project encounters serious problems or is cancelled, RERA and DLD have regulatory and liquidation procedures for dealing with the project and investor funds. Recovery is not automatically guaranteed from the remaining escrow balance and can depend on the project's status and applicable legal procedures.

Question 5

What are typical gross rental yields in Dubai freehold areas?

Accepted Answer

Gross rental yields vary significantly by community, property type, unit size and purchase price. As a general market range, premium waterfront and prime central communities may produce lower gross yields than more affordable, higher-rent-to-price communities. Propertic calculates gross yield as annual rental value divided by property purchase price, using Dubai Land Department (DLD) transaction data and the DLD Rental Index where applicable. Every yield we quote is a Propertic-derived calculation using DLD rental and transaction data, a historical/current market estimate, not a guaranteed future return. Net yield will be lower after service charges, maintenance, management and other ownership costs.
